1. Placing an Order & Stock Availability
1.1.
All items offered on our website are subject to acceptance and availability,
please note: the automated email you receive after ordering is not an acceptance
of your order. Offers are valid for all completed sales (i.e. goods have been
dispatched) up until
1.2.
Orders for any of our products can be placed via our Secure Online Server or by
completion of a manual application form, which can be faxed or posted back to
us.
1.3.
Telephone orders will be accepted but goods will not be dispatched until payment
has been received, and for pay monthly orders, a completed contract form and the
relevant proofs must be received by us, where required.
2.
Credit/Debit Card Payment & Address Validation
2.1.
TK Communications owners of TheMobilePhoneZone.com will endeavour not to debit
any credit/debit cards until an order is ready for processing/despatch, however
in some instances it may be necessary to debit and immediately refund a small
amount to a card in order to verify that the card and address provided are both
valid.
2.2.
By placing an order with TK Communications owners of TheMobilePhoneZone.com you
automatically consent to the necessary checks being conducted, in the interest
of fraud prevention, such as checking that the address and credit/debit card
details are correct and that they belong to the customer placing the order
(you). These checks are known as AVS
and CV2 checks.
3.
Web site Accuracy
3.1.
Our web site design team work extremely hard to make sure our web site is as
accurate as possible and in order to achieve this, our web site is updated
regularly.
3.2.
However we cannot guarantee the accuracy of information supplied, especially
such things as mobile phone handset specifications and network tariff
information and special offers, which may change without prior notice to us. All
Errors and Omissions are excepted.
3.3.
All offers displayed on our web site remain valid until

Product Warranty
4.1.
All mobile phones come with a 12-month manufactures warranty. This warranty does
not affect your statutory rights, which cannot be excluded or restricted by law.
4.2.
Additional insurance and extended warranty periods for mobile phone handsets
maybe available either free or at an extra cost on certain products.
5.
Delivery
5.1.
All parcels are delivered by Royal Mail Service or by Courier. The service type
used will depend upon the value and/or type of product/s purchased. Recorded,
Special Delivery & Courier deliveries require a signature upon delivery, for
contract phone orders the person taking out the contract must sign for the phone
upon delivery.
5.2.
Accessories & Prepay SIM cards - we endeavour to despatch all in stock
accessories within 1-2 working days of the order being placed and full payment
being received. Accessories and prepay SIM cards are delivered by Royal Mail 1st
Class or Recorded Post.
5.3.
Mobile Phone Contracts REQUIRING signed contracts and proofs - we endeavour to
despatch all contract mobile phones within 2-3 working days of the relevant
paper work, (signed contract & relevant proofs) being returned to TK
Communications. These items are sent
either by Royal Mail Special Delivery, which is Insured Next working Day
Delivery. Saturday delivery cannot be guaranteed.
5.4.
Mobile Phone Contracts NOT REQUIRING signed contracts and proofs prior to
delivery - we endeavour to despatch these connections within 2-3 working days of
ordering, subject to your credit/debit card & address being validated, using
AVS and CV2 checks (section 2.2) and acceptance by your chosen network.
These phones are delivered by Courier to the home address registered with
your card issuer and must be signed for by the customer (YOU).
Saturday deliveries are by special arrangement only and a fee will apply.
5.5.
We cannot be held responsible for any delays with the Royal Mail or a courier
delivery service.
5.6.
Parcels sent to remotes parts of the

An additional delivery charge maybe applicable on orders to other countries.
5.8.
TK Communications cannot be held responsible for any delays resulting due to
incomplete or inaccurate information being provided at the time of ordering.
5.9.
The first delivery attempt is free of charge however TK Communications reserve
the right to charge, at “cost” price, for any subsequent delivery attempts.
6.
Privacy of Information
6.1.
Any information collected by TK Communications, owners of
TheMobilePhoneZone.com, including that gathered at the time of
ordering/registration, is collected lawfully and in accordance with the Data
Protection Act 1998.
6.2.
TK Communications do not sell or transmit any customer's personal information,
including email addresses, to any organisation for any purpose other than for
processing orders placed with us (if necessary).
6.3.
We do reserve the right to provide information to the relevant authorities in
the interest of preventing fraud or crime.
6.4. From time to time we may send you information via email or post regarding
your purchase or regarding other services/products available from
TheMobilePhoneZone.com. 6.5. You can
always "opt-out" or "unsubscribe" from our electronic
mailing list to stop you from receiving any further mailings if you so wish.
6.6. If you require any further information regarding our Privacy of Information

7.
Pricing
7.1.
Unless we indicate otherwise, all prices stated include VAT and delivery. All
Errors and Omissions are excepted. Prices
are subject to change at any time.
8.
Mobile Phone Contract Connections and SIM Card Connections
IMPORTANT:
If you are or have been an existing network customer of the network you
wish to connect to and have an existing contract, or you have disconnected a
previous contract with the same network within 30 days of the date of placing an
order with us, you must make us aware of this at the time of ordering.
PLEASE ALSO READ THE TERMS & CONDITIONS VERY CAREFULLY.
8.1.
If for whatever reason you have disconnected a previous contract with the same
network as you have placed an order for a phone on, with us, within 30 days of
the date of placing the order, then TK Communications reserve the right to
charge you (the customer) the full value of the handset, if you take delivery of
or use the phone. The full value of
a handset is considered to be the price which TK Communications, owners of
TheMobilePhoneZone.com, paid for the handset including VAT and delivery.
TK Communications also reserve the right to charge you (the customer) for
any costs incurred whilst processing your order due to you failing to inform us
of you having ended a contract with the same network within the last 30 days.
E.g. if you order a phone on Vodafone (Vodafone is used for example
purposes only and this applies to all networks) and an existing contract with
Vodafone, which was in your name, has ended within the last 30 days, and you
proceed with your order with us (TK Communications), then we (TK Communications)
could charge you the full value of the handset at any time, without notice.
The full value of a handset is typically, but not limited to, between £100
and £600 depending on the handset and network connected to.
8.2.
If you take out a new connection on a network which you currently hold
another contract (pay monthly) connection with and subsequently disconnect the
existing contract within 45 days of receiving your new phone on a new contract
with the same network, then TK Communications reserve the right to charge you
(the customer) the full value of the handset.
The full value of a handset is considered to be the price which TK
Communications, owners of TheMobilePhoneZone.com, paid for the handset including
VAT and delivery. The full value of a handset is typically, but not limited to,
between £100 and £600 depending on the handset and network connected to.
8.3.
All mobile phone and SIM card connections (excluding prepay SIM cards &
handsets) are subject to a minimum term airtime contract.
The duration of this contract is 12 months unless otherwise stated on our
website (www.themobilephonezone.com)
or in any written agreement between either; TK Communications and you (the
customer) or between you and the network you are connecting to. All
connections (excluding prepay) may be subject to a connection fee. All contract
connections are subject to status and acceptance by the Network concerned to
8.4.
A credit check will be carried out by the network/provider prior to connection
using the information supplied by the applicant (you/the customer). We will
always advise the applicant (you/the customer) of any negative credit
assessments and connection refusals. TK Communications cannot be held
responsible for the result of any credit assessments or for any delays caused by
insufficient or incorrect information being supplied by the applicant.
8.5.
You (the consumer) must remain connected to the tariff selected, at the time of
connection, for a minimum of 6 months from the date of connection.
TK Communications will charge you (the customer) for any costs incurred
as a result of a tariff change within the first 6 months of your contract, even
if such a change of tariff is allowed or advised by the network/service provider
you are connected with. Please note further terms & conditions govern
eligibility for cash back offers.
8.6.
Please note by placing an order for an Orange,
O2, Vodafone, T-Mobile or 3 contract mobile phone through TheMobilePhoneZone.com
you are automatically entering into a 12 month minimum term contract, unless
otherwise stated (see 8.3), with the respective service provider for the
product(s) and service(s) ordered, which is governed by their terms and
conditions, which are available on request.
8.7.
TK Communications can not be held responsible for the consequences of any
mistakes you may make when placing an order or using the site, however we will
endeavour to contact all customers either by email or telephone before an order
will be processed.
9.
Cash Back
9.1.
The cash back is paid, to you (the customer), by way of a cheque at the end of
the minimum term of the contract; in accordance with the terms and conditions,
as detailed in points 9.2 to 9.6 inclusive.
9.2.
The offer of cash back is an offer run by TK Communications, owners of
TheMobilePhoneZone.com, and is only available on a brand new service agreement
with a minimum term contract of either; 12 months, 18 months or 24 months, as
indicated on our website at the time of ordering (themobilephonezone.com).
9.3.
The offer of cash back is only available on selected offers, to the value
indicated, on TK Communications’ website (www.TheMobilePhoneZone.com).
9.4.
The offer of cash back is not available if you are taking out a connection with
a network with whom you currently have a contract (pay monthly) mobile phone,
nor if you then subsequently disconnect a phone with that network within 45 days
from the date of connection of the new phone supplied by TK Communications, nor
if you have had a phone with the same network that has been disconnected within
30 days prior to the date of connection of the new phone supplied by TK
Communications.
For
clarification: Taking out an additional mobile phone with a network with whom
you currently have a contract/pay monthly phone, in your name, IS permissible as
long as neither phone is disconnected within 45 days from the date of connection
of the new phone; and a handset/contract, in your name, has not been
disconnected with the same network within 30 days prior to the date of
connection of the new handset.
9.5.
The offer of cash back will become void if you change your tariff before the end
of the minimum term contract (unless you have obtained written permission from
TK Communications prior to any changes being made), or if TK Communications
incurs any costs from the network/service provider to which you originally
connected due to you having breached either the network/service provider’s
terms & conditions or TK Communications’ terms & conditions, or if you
fail to pay your bills, or if you disconnect any additional services within 6
months of the date of connection.
9.6.
TK Communications will not pay out any cash back where fraudulent activity is
suspected, or if completed, signed, contracts and proofs are not returned to TK
Communications when required. You
will be notified when placing your order if you are required to sign a paper
contract or provide proofs of address or signature.
10.
Returning Products
10.1.
If for any reason you wish to return a product or receive a replacement product
please call our Customer Service Team on 07870887934 or email customer.services@themobilephonezone.com for assistance, it
may be necessary for you to contact the Network/service provider before you can
return your product, where this is the case, you will be advised by a member of
our customer services team.
10.2.
We would request that you contact our Customer Service Team as soon as any
problem becomes apparent.
10.3.
We will deal with all replacements and refunds with high priority.
10.4.
Replacements will be sent out when the original item is returned in its original
condition.
10.5.
It is the customer's responsibility for the safe return of any goods. All items
must be returned as they were received with their original packaging and full
contents included, along with original documentation and proof of purchase.
Any additional items included in the deal such as, but not limited to,
accessory packs, hands free kits or other “free gifts” must also be returned
unused, in their unopened, original packaging.
In the event that you fail to return any additional items supplied with
the phone, TK Communications reserves the right to charge you (the customer) for
the full value of any such items.
10.6.
Where a refund is sought for non-faulty items we reserve the right to charge the
initial cost of delivery as incurred by TK Communications. We will not charge
for the initial costs of delivery where the product supplied was faulty.
10.7.
Refunds cannot be given if we judge that the product has been wilfully or
accidentally damaged, misused, neglected, overloaded, modified, adapted or
repaired.
10.8.
Where contract handsets have been used within the 14 day satisfaction guarantee
period, TK Communications reserves the right to give a partial (but fair) refund
depending on the amount of use the product has received.
11.
Returning Contract Connections and Contract SIM Connections
11.1.
If you are dissatisfied in any way with any contract connection or contract SIM
connection and wish to cancel your agreement under the 14 day satisfaction
guarantee, offered by the networks, you must contact our Customer Service team
immediately by emailing; customer.services@themobilephonezone.com
Our customer service team will then advise you to return the item, to arrive
with, TK Communications within 14 days of the date of connection of the phone.
You may also be required to contact the network that the phone is
connected to for such a return to be authorised under the network’s terms
& conditions.
11.2.
Upon safe return of the product we will remit to you a full refund.
11.3.
All items must be returned as they were received with the original packaging and
full contents included along with original documentation and proof of purchase.
11.4.
Where a refund is sought we reserve the right to charge the initial cost of
delivery, as incurred by TK Communications. We will not charge for the initial
costs of delivery where the product supplied was not of satisfactory quality.
11.5.
Clause 11 does not apply to pay as you go or pre-paid hand set packages.
12.
Complaints
12.1. If you have cause for complaint regarding any service or product provided
by TheMobilePhoneZone.com please email full details to customer.services@themobilephonezone.com.
13.
Recommend a friend
13.1.
To qualify for cash back for “recommending a friend”, the recommended
friend must successfully connect to, and remain connected to a new pay monthly
price plan purchased through TheMobilePhoneZone.com, and must name you, when
asked where they found out about TheMobilePhoneZone.com.
Cash Back, to the value advertised, per friend is paid by redemption
after month 12 of your friend’s contract.
13.2.
For a connection to be classed as successful, a customer must connect to, and
remain connected to the tariff as chosen at the time of ordering for 6 months
from the date of connection and TK Communications must not incur any costs from
the network connected to as a result of the customer or you being connected, or
the customer or you being in breach of either the network’s or our terms &
conditions.
13.3.
Cash back for recommending a friend will only be paid to existing customers of
TK Communications and will be paid by redemption, after 12 months of the date of
the friend connecting provided the above conditions have been met. You must
write to TK Communications at their advertised address stating your name and
address and the recommended friend’s name, your mobile number and account
number and the recommended friend’s mobile number and account number.
13.4.
The offer of cash back for “recommending a friend” is not available if the
purchase made by the friend takes advantage of any other offers run by TK
Communications other than those advertised on our website (www.TheMobilePhoneZone.com)
at time of ordering.
14.
Insurance
14.1
Where FREE
insurance is offered, it is only for the duration advertised on the site (E&OE).
14.2
After the initial
FREE period, the company offering the insurance will charge £4.99 a month for
the insurance cover on 2G phones and £5.99 a month on 3G phones.
If you do not wish to continue the cover you must cancel the cover before
the FREE period is up.
14.3
The insurance
cover is subject to terms and conditions available upon request.
14.4.
You may need to provide TK Communications with additional information, to pass
on to the insurance company, required for setting up the insurance cover, this
information must be provided immediately upon request or the insurance will
become invalidated and the offer of FREE insurance will be void.
14.5.
TK Communications can not be held responsible for any problems arising from the
insurance or the offer of insurance, as this is an offer made by the insurance
provider and any problems must be settled between you (the customer) and the
insurance provider.
14.6.
Unless you (the customer) receives a letter from the insurance company notifying
you that your policy has been started you are to assume that your phone
insurance policy has not started and must contact the insurer immediately to
rectify this situation or you will not have insurance cover, TK Communications
can not be held responsible for any out come arising from an incidence where the
insurance policy is not set up or is set up incorrectly as the insurance is
provided by a third party and not by TK Communications.
14.7.
All phone insurance is offered by a third party. TK
Communications only act as an introducer and do not insure any product
ourselves. It is important that you read and understand the terms and conditions
of the third party insurance company. Should the third party insurance company
refuse to insure a product or refuse a subsequent claim, this may not be used as
a reason to return any product(s) or break a contract with a mobile phone
network or service provider.
15.
NETWORK PROMOTIONS
15.1.
A “network promotion” for this purpose, is defined as any promotion or offer
run by the network or service provider, as supposed to an offer run by TK
Communications owners of TheMobilePhoneZone.com.
Network or service providers include but are not limited to:
15.2.
TK Communications, owners of TheMobilePhoneZone.com can not be held responsible
for any changes to a network promotion from those advertised our web, as these
promotions are run by the network or service provider and are beyond the control
of TK Communications. Whilst every
effort is made to keep our website up to date, these promotions are liable to
change at anytime and changes are not always communicated to TK Communications
prior to a change being made.
15.3.
TK Communications can not be held responsible for any problems arising, either
directly or indirectly, as a result of a network promotion.
15.4.
Network promotions are subject to terms and conditions, which are set by the
network or service provider running the promotion.
16.
Mobile Number Transfers
16.1.
The service of transferring your existing mobile number to a new contract is
offered by TK Communications, owners of TheMobilePhoneZone.com, and is only
available if all necessary information is provided at the time of ordering,
including (but not limited to) PAC code, existing mobile number and existing
network; and provided that you have authorisation from your existing mobile
phone network/service provider to transfer your existing number, and that by
doing so you would not be breaching either the network’s or TK
Communications’ Terms & Conditions. Please note, not all customers will be
eligible to retain their existing number when taking out a new contract
(including, but not limited to, some Prepay/Pay As You Go customers).
16.2.
TK Communications can not be held responsible for any loss, financial or
otherwise, occurring either as a result of a delay in a mobile number transfer,
or in the event of a mobile number transfer not being possible, or for any
errors arising due to or during the transfer.
16.3.
In the event of a mobile number transfer spanning two calendar months, TK
Communications can not he held responsible for any changes to the tariff or line
rental on the new contract as these changes are made by the network/service
provider and are beyond the control of TK Communications.
16.4.
If your mobile number transfer spans two calendar months, TK Communications
reserve the right to charge you the difference in selling price between the
month of ordering and the month in which the mobile number transfer took place.
16.5.
Please not that cancelling your contract under the 14 day satisfaction guarantee
may result in the permanent loss of the mobile number being transferred, and any
temporary number issued by the network/service provider, TK Communications can
not be held responsible for this loss or any other loss arising directly or
indirectly from this.
17.
Your Legal Rights as a Consumer
These
Terms and Conditions do not affect any of your statutory rights, which cannot be
excluded or restricted at law. In
the unlikely event that any of these terms are judged unlawful in a English
court of law, all other terms covered in these Terms & Conditions will
continue to be valid.
